State Fines Utilities Millions for 2011 Storm Responses

National Grid was fined nearly $19 million, the highest fine levied against utilities in Massachusetts.

The state on Tuesday ordered a total of $24.8 million in penalties to utility companies for their response to storms in 2011. Massachusetts Energy and Environmental Affairs Secretary Rick Sullivan joined Department of Public Utilities (DPU) Chairman Ann Berwick and DPU commissioners today to announce the findings of the DPU’s investigation into responses to Tropical Storm Irene and the October 2011 snowstorm. Provided the penalties hold up, customers should see a reduction in their bill, though it is unclear how much, officials said.  National Grid faces the steepest penalty, at $18.725 million. NSTAR has been ordered to pay $4.075 million, while the Western Massachusetts Electric Company faces a $2 million penalty. National Grid told the …

D.J. Henry's Family Files New Suit Against Mount Pleasant and Two Officers

The complaint alleges that police officers Kevin Gilmartin and Officer Ronald Gagnon neither checked on or sought treatment for the Easton native who had just been shot by Pleasantville police Officer Aaron Hess.

A second lawsuit against police officers who responded to reports of a crowd outside a Thornwood bar and shot an Easton native attending Pace University  will be filed in federal court Oct. 12.  Aaron Hess, a Pleasantville police officer, killed D.J. Henry on Oct. 17, 2010, shooting him from the hood of Henry's car as Henry was driving. He was not indicted by a Westchester County Grand Jury; the family filed a wrongful death lawsuit. The U.S. Justice Department is also investigating. Michael Sussman, attorney for the Henry family, said the story coming out through depositions for the first lawsuit, which was filed against Hess and his employer the village of Pleasantville, drew a very different picture than that described by police right …

I read on another website that Aaron Hess was granted medical retirement. Instead of facing the music for his misrepresentation (outright LIES IMHO) of the DJ Henry murder, he retires. Hopefully Hess and the officers who held DJ down AFTER he was shot ALL face some punishment   more ›

Judge gives parties eight months before next conference date.

Attorneys in the nine lawsuits pending as a result of the shooting and subsequent death of Pace University student and Easton native Danroy "DJ" Henry on Oct. 17, 2010, met in U.S. District Court this morning. Judge Kenneth Karas is overseeing the case and met with the parties in White Plains to conference the matters. Most recently, several of Henry's peers—including those who were previously arrested the morning of his death (charges were later dismissed)—announced they are suing the county, Village of Pleasantville Town of Mount Pleasant and related individual law enforcement officers for police brutality. Yves Delpeche, Joseph Garcia and Desmond Hinds, are each suing—through their attorney Bonita Zelman—Westchester County, the Town of …

DJ Henry's Peers Sue County, Pleasantville and Mount Pleasant Police

Henry's peers announced the filing of several lawsuits Saturday.

On the eve of the one year anniversary of the shooting death of Pace University student and Easton native Danroy "DJ" Henry, family, friends and members of the community gathered on the steps of the Federal U.S. District Courthouse in White Plains to announce several lawsuits as they continue the fight for justice in Henry’s death. Yves Delpeche, Joseph Garcia, Joseph Romanick and Daniel Parker—Henry’s peers who were allegedly beat up and tasered as they tried to help him that night—were later arrested and prosecuted. The charges were later dropped by the Westchester County District Attorney's office.  “We stand here today on the one year anniversary of [Henry's] death,” said Bonita Zelman, an attorney for the students. “His life was …
